what3words Amazon Alexa Ride Skill | Terms of Use

These Terms of Use were last updated on 20 March 2019.

We are what3words Limited, a company registered in England and Wales under company number 08430008 and with our registered office at Dewmead House, Hinxworth, Baldock, Herts, SG7 5HD. References to “what3words”, “we”, “us” and “our” are references to what3words Limited.

These Terms of Use govern your use of the what3words Amazon Alexa Ride Skill (“what3words Alexa Ride Skill”), which allows you to order transportation via Uber through your Alexa-enabled device to a “three word address” (being any of the combinations of 3 words which have been developed and generated by us and are discoverable and searchable by you using our website or mobile application).

Please read these Terms of Use carefully before using the what3words Alexa Ride Skill. If you do not agree to them in their entirety, then you may not use the what3words Alexa Ride Skill.

These Terms of use apply in addition to any other policy or agreement that you may have with what3words, including our main Terms and Conditions, as found here: which apply in respect of your use of the what3words website and consumer mobile application.

 

1. AMAZON

Amazon Alexa is cloud-based voice service provided by Amazon Digital Services LLC and/or their affiliates (“Amazon”), made available on devices made by both Amazon and third-party device manufacturers (“Alexa-enabled device”, such as the Amazon Echo).

When using the what3words Alexa Ride Skill, you continue to be bound by the Terms and Conditions under which you agreed to upon creating an Amazon Alexa account, as well as any terms and conditions which apply to your Alexa-enabled Device, including: alexa.com/help/terms.

what3words is not responsible for and accepts no liability for any damage to your or any other person’s Alexa-enabled device relating to or resulting from using the what3words Alexa Ride Skill or downloading the Amazon Alexa App.

 

2. UBER

Uber USA, LLC (or the applicable Uber affiliate responsible for delivering Uber services in your territory) (“Uber”) provides certain transportation booking services. When making an Uber booking using the what3words Alexa Ride Skill, you are using Uber’s services, which are subject to the terms and conditions made available by Uber from time to time at: uber.com/legal/terms/.

what3words is not responsible and accepts no liability in respect of the provision of services to you by Uber or any contractor engaged by Uber to provide you with transportation services.

You will be solely responsible for any payment due to Uber for services provided to you by Uber.

 

3. USING THE WHAT3WORDS ALEXA RIDE SKILL

In order to use the what3words Alexa Ride Skill you will need to activate it via a smartphone application (the “Amazon Alexa App”). You do not require a what3words customer account. However, you will be required to link your Uber account to your Amazon Alexa account.

The what3words Alexa Ride Skill is available in English in the following territories (subject to the continued availability of the Uber service in those territories): Australia, India, Canada, United Kingdom and United States (“Territories”).

Using the what3words Skill consists of you speaking a command aloud to your Alexa-enabled device, requesting it to order transportation via Uber to a three word address.

what3words will then send back to your Alexa Device the suggested three word address to which you would like to order transportation via Uber.

Before proceeding to book transportation with Uber via the what3words Alexa Ride Skill, your Alexa enabled device will ask you to confirm the three word address you have entered.

Any command given to Alexa from your device will be treated as authorised by you.

 

4. RESTRICTIONS

In order to use this skill you must: (1) be 18 years or older; (2) have an internet connection (2) have an Alexa enabled-device; (3) have an Uber account; (4) If you are using a GPS enabled device, enable this function so that we are able to suggest the three word address which is closest to your location; (5) allow us to access your device location; (6) be located in one of the Territories when using the what3words Alexa Ride Skill. If you do not agree or cannot comply with these restrictions, then you may not use the what3words Alex Skill.

 

5. THIRD PARTY SECURITY

Depending on the security settings of your Alexa-enabled device, it may be possible for you to allow others to access to the what3words Alexa Ride Skill. By allowing other users to access and/or use the what3words Alexa Ride Skill, you assume all liability and responsibility for how the what3words Alexa Ride Skill is accessed and/or used. what3words will not be responsible for any use of the what3words Alexa Ride Skill by anybody other than you.

 

6. PERSONAL DATA

We do not collect any personal data through your use of the what3words Alexa Ride Skill. Whilst we use your current location, or device location, to enable our autosuggest function to suggest the most appropriate three word address , we do not retain this data. In addition, in the absence of any other identifier (such as IP Address or Device ID), this does not amount to personal data.  We do not have any way of identifying you as a user of the what3words Alexa Ride Skill.

Amazon may also record your interactions with the what3words Alexa Ride Skill or with Amazon Alexa. Amazon provides information around how handles your personal data within the Amazon Alexa Privacy Notice, as found here: alexa.com/help/privacy.

 

7. ACCURACY

what3words does not design or manufacture either the Amazon Alexa product or your Alexa-enabled device, and has no control over them. It is possible that Alexa may not hear you properly, may misinterpret what you say, or may say something to you that is different from the information that what3words provided to Alexa in response to your question. what3words therefore accepts no responsibility for any damage, loss, liabilities or injury incurred or suffered by you or by third parties as a result of using the what3words Alexa Ride Skill, including as a result of what3words providing inaccurate, untimely, incomplete or erroneous information. what3words is also not responsible for the accuracy of three word address provided by any third party, which you may choose to request Uber to arrange transportation to.

 

8. THREE WORD ADDRESSES

While we have made all reasonable efforts to remove potentially offensive words from our three word addresses, we shall not be liable to you for any words, word combinations or word orders which may be offensive, upsetting or annoying in any way or for any reason to you, to anyone receiving those words for any purpose (for example, in communicating the location described by the words in question) or to anyone or anything associated with the location described by those three words.

We do not intend to make changes to words in our list of three word addresses or any three word address, but we cannot rule out that in exceptional circumstances this may be necessary. Accordingly, we reserve the right to change any words in our list of three word addresses and any three word address and shall not be liable to you if any three word address previously supplied ceases to work or for any consequences of such cessation. In the event that we do have to make any changes, we will implement an appropriate transition plan to minimise disruption.

Nothing in these Terms of Use is intended to transfer to any third party any intellectual property rights in our list of three word addresses, in any three word address, any software we have developed or in any product or service we provide.

 

9. ADDITIONAL COSTS

what3words shall not be responsible for any costs associated with using the what3words Alexa Ride Skill including the purchase and use of an Alexa-enabled device, the internet connection or any charge incurred by you through your use of Uber’s services.

 

10. CHANGES AND MODIFICATIONS

what3words reserves the right to modify or discontinue the what3words Alexa Ride Skill at any time without prior notice. The number and range of services offered via Amazon Alexa may change over time and depend on Amazon’s current offer and availability.

what3words reserves the right to amend these Terms of Use from time to time. The latest version of Terms of Use shall be always available on the what3words website. Any amendments shall become part of these Terms of Use. If you continue using the what3words Alexa Ride Skill after the amendments have taken effect, we will assume that you agree with the amendments and they shall become effective for you. Should you object to the amendments, the amendments shall not be effective for you and as a result you shall not be entitled to use the Skill anymore.

 

11. TERMINATION

what3words may terminate your access to the what3words Alexa Ride Skill at any time and without notice if you fail to comply with any of terms herein. what3words may also terminate your access to the what3words Alexa Ride Skill if the Skill is no longer available.

 

12. RESPONSIBILITY

what3words accepts no responsibility and liability for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of using the Skill, including as a result of us and/or our partners providing inaccurate, untimely, incomplete or erroneous information. what3words  shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

All information is provided “as is”, without any representation as to fitness for any particular purpose and without warranty of any kind, express or implied. The information provided by the skill is for information purposes only, and does not constitute advice of any kind and shall not create any warranty of any kind.

 

13. OTHER

If you wish to contact us in writing, or if any clause in these Terms of Use requires you to give us notice in writing, you can send this to us by e-mail to support@what3words.com We will confirm receipt of this by contacting you in writing, normally by e-mail.

We may transfer our rights and obligations under these Terms of Use to another organisation, but this will not affect your rights or our obligations under these Terms of Use.

You may only transfer your rights or your obligations under these Terms of Use to another person if we agree in writing.

These Terms of Use are between you and us. No other person shall have any rights to enforce any part of these Terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise and we and you will not need their consent to cancel or make any changes to these Terms of Use.

Each of the paragraphs of these Terms of Use operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

If we fail to insist that you perform any of your obligations under these Terms of Use, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

These Terms of Use are in the English language. If you choose to translate them into any other language then the English language will be the version that applies.

These Terms of Use are governed by and interpreted in accordance with English law. This means any dispute or claim arising out of or in connection with these Terms will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction.
